A member of the Indonesian WTO mission told the Reuters that it is filing a dispute with the World Trade Organization (WTO) over a September 2009 US Food and Drug Administration (FDA) ban on cigarettes with fruit, candy, cinnamon, vanilla, cocoa, licorice, coffee, or clove flavors. Indonesia claims that the ban is unfair as it excludes menthol-flavored cigarettes and discriminates against foreign tobacco companies while giving unfair assistance to domestic producers.
The two countries will now have up to 60 days to try to resolve their differences, according to WTO rules. If no settlement is reached, Indonesia can ask the trade organization to set up a panel of mediators to arbitrate the dispute.
